- Article 1: The seller
- HiddenTreasures.be, hereafter called the seller, is registered at the address Aalterstraat 32, 9880 Aalter (Belgium) with business registration number 0648.539.624 and VAT number BE 0648 539 624. The owner is Heidi Vervaecke.
- Article 2: Sales agreement
- There is a sales agreement between the Seller and the Buyer when an order is placed by the Buyer who confirms accepting the general conditions when ordering. The Buyer confirms being in the legal position for ordering online. Visitors of the site or called users.
- Both parties accept all electronic mail and documents regarding the law of July 9th 2001. A confirmation of an order has the same legacy as a hand signed order.
- Article 3: Articles and prices
- The products are those products the Seller offers online for sale on the day the Buyer visits the site. The Seller takes care of giving a good view of the products by pictures and descriptions. It may happen though that there are differences in colour due to, for example, a difference in computer settings.
- All prices include VAT, but do not include shipment costs. All prices are those valid on the day of ordering. It may happen that after having ordered, a product may have a lower price due to the sale period. Then the Buyer cannot claim any refund.
- Article 4: Confirmation of an order and payment
- An order will only be confirmed after the Seller has sent an electronic confirmation to the email address the Buyer has given.
- The order will only be shipped after having received full payment (unless the order will be picked up).
- The Seller retains the right to refuse an order from a Buyer with whom there has been a conflict in the past.
- An order can be paid online or by bank transfer. A European bank transfer does not involve any costs. The Buyer must make sure the payment will be done without any extra cost for the Seller. In case there are additional costs for the Seller, the Buyer will have to pay this.
- All online payments are handled by OGONE. OGONE is the market leader in Europe for secure online payments. The Seller has no access to the confidential data of his Buyers.
- Article 5: Delivery
- An order will only be shipped after receipt of the entire payment and this within 3 working days after the receipt of the payment.
- The Seller cannot be held responsible if a wrong shipment address has been submitted by the Buyer. Any costs related to a new shipment will be born by the Buyer.
- The Seller will ship the order by the postal service selected by the Buyer. In case the Buyer has not selected a secured shipment, the Seller cannot be held responsible for any loss.
- The Seller cannot be held responsible for any delay in postal services.
- Article 6: Return or exchange
- De consument heeft het recht aan de onderneming mee te delen dat hij afziet van de aankoop, zonder betaling van een boete en zonder opgave van motief binnen 14 kalenderdagen vanaf de dag die volgt op levering van het goed of op het sluiten van de dienstenovereenkomst.
- The Buyer will confirm any return or exchange by email to retour@hiddentreasures.be. All returned products must be sent in the original package and with all the original labels to the following address: Hidden Treasures, Stationsstraat 12, 9880 Aalter (Belgium). The Buyer will send all returned goods at own risk.
- If the Buyer does not ask for an exchange, the Seller will refund the paid amount of the returned goods within 30 days. Should the Buyer require an exchange, then the Seller will recalculate the refund or the balance. Postal costs of a return are always born by the Buyer.
- Article 7: Complaints
- The Seller takes great care in controlling all products before shipment and in packing the goods in a decent box. Nevertheless, an imperfection may be found by the Buyer on receiving the order. Should this happen, the Buyer has to contact the Seller immediately by email to sales@hiddentreasures.be. The Seller guarantees a correct handling of the complaint and will bear all extra costs if he is responsible for the imperfection.
- Article 8: Privacy
- All personal data disclosed to the Seller is for internal use by the Seller. The Buyer and alls users have the right to look into their data and to change or delete the data if wanted.
- The personal data will be used for the administrative handling of the order, the delivery and the invoice, for the follow-up of payments, and for marketing goals if the Buyer or user has agreed to this. No data whatsoever will be given, sold or hired to third parties.
- The Seller uses cookies. A cookie is a piece of text stored by a user's web browser. A cookie can be used for authentication, storing site preferences, shopping cart contents or anything else that can be accomplished through storing text data. The Seller guarantees that cookies will only be used for personalizing his services.
- All users have the right to reject cookies but in that case the user has no longer the possibility of a personalized service offered by the Seller.
- Article 9: Exceptions/conflicts
- The Seller cannot be held responsible for any deficiency in the handling of an order if this is due to a force majeure such as strike, fire or flood, or any other circumstance stipulated in Belgian law.
- The general conditions as stated above are governed by the Belgian court. The Sellers undertakes to follow the Code of Conduct set up by the Belgian Direct Marketing Association. In case of conflicts an amicable settlement should be aimed at before any legal action will be taken. If not so, Ghent is the only court of jurisdiction.
